Preamble

Please read these terms and conditions carefully before using the Deafworks’ website. By using or accessing our website, you agree to be legally bound by these terms and conditions of use as they may be modified and posted on our website from time to time. If you do not wish to be bound by these terms and conditions then you may not use our website.

Disclaimer

All text, photographs, videos and any other media presentation provided on the Deafworks’ website is provided for information purposes only. Information on this website is subject to change without prior notice. Whilst every reasonable effort is made to ensure that the information on the website is complete, correct and up-to-date, this cannot be guaranteed and Deafworks shall not be liable whatsoever for any damages incurred as a result of its use.

Deafworks takes no responsibility for the content of external websites. The existence of a link to an external website or a link to the Deafworks’ website from an external website does not imply that Deafworks endorses the activities or views of that organisation.

The contents of Deafworks’ website are protected by international copyright laws and other intellectual property rights. The owner of these rights is Deafworks. Any use of information on the website should be accompanied by an acknowledgment of Deafworks as the source. Reproduction or translation of substantial portions of the website require explicit, prior authorisation in writing. Deafworks

Deafworks comprises a group of people (the majority of whom are Deaf) working on a freelance basis. It is not a College or an Adult Institute, and does not receive any grants. The partners do not receive any salary from another organisation. Our booking and fee policies therefore combine two objectives: our wish to keep costs as low as possible, and the need to ensure that every course and all our other work fully cover the costs involved in providing them.

Terms for Deafworks’ workshops

These terms will apply to all Deafworks’ own courses, whether booked via the website or by any other means:

Concessionary Fee Rate

A concessionary rate is available to anybody paying for themselves. This rate is not available where the fee is being reclaimed from an employer, a grant-making trust, a trade union, or any other organisation.

Booking

We will accept a provisional booking in writing, by email, fax, minicom or by ‘phone. Please ensure you leave your name, address and contact telephone numbers. Only payment in full will confirm the booking: however, the place will be held for a reasonable period on a temporary basis until payment is received.

Acceptance

  • For some courses applicants may need to fulfil specific requirements to be accepted.
  • Deafworks reserves the right not to admit an individual to a course.
  • In accepting a place on a course, applicants will be expected to adhere to principles of equal opportunities and of shared learning within the group.

Cancellation

  • We will return your fees (less an administration charge) if you cancel your place at least 6 weeks ahead of the course (4 weeks for a one day course).
  • If you cancel later than this, we will try to fill your place from our waiting list. If we fill it we will return your fee (less the administration charge). If we cannot fill your place, we cannot return your fees.

Please let us know as early as possible – this helps us both!

Transfer of Place

If you cannot attend but a colleague / friend / relative wishes to attend in your place, the booking can usually be transferred to their name (provided they fulfil any application requirements related to a specific course), but this subject to Deafworks agreement.

Invoices (Organisations)

  • Places are booked and held for organisations on the assumption that the invoice for the fee will be paid (the cancellation conditions above will then apply as though the fee had been paid).
  • Organisations wishing to reserve the right to cancel a booking before the invoice is paid must notify the Course Administrator at the time of booking: however, we will not be able under these circumstances to hold places should the course fill up before the invoice is paid.

Absences

  • Anyone enrolling for a course will be invoiced for its full duration. No reductions can be made in respect of late arrival, early departure or absence during any part of the course.
  • It is not possible to reimburse applicants who are unable to attend part or all of a course because of ill-health or under other circumstances. The general guidelines on “Cancellation” will apply.

Other Information

  • Deafworks reserves the right to cancel courses, change plans or engage alternative tutors, if and as circumstances dictate. Courses will generally be cancelled where there are less than 5 applicants.
  • If for any reason, Deafworks has to cancel a course, applicants will be informed as soon as possible. Any fees paid in respect of the course will be refunded. Deafworks will not be liable for any additional cost or expense arising.
  • It is the course applicant’s responsibility to let us know at the time of booking about any special needs which will affect their access to the course and to training materials. We have a policy of accommodating applicant’s needs as much as we reasonably can.

Terms of Business

All work carried out will be subject to the detailed terms of each specific contract. In general it should be assumed that any piece of work carried out by Deafworks will subject to these general terms. All terms are subject to negotiation with individual clients.

Late Payment

In the event that payment is not received by the date specified with the client, a Late Payment Charge will be levied. This will be charged for each month from the date the work (or each part of the work) was completed. The Late Payment Charge will be for £15 or 5% of the invoice (whichever is the greater) for each month that payment is overdue.

Cancellation

If the client cancels, or postpones the work to a later date, prior to the work being carried out, the following proportion of the fees (together with any expenses already paid out) will be charged:

4 – 6 weeks beforehand – 25% of the fee

2 – 4 weeks beforehand – 50% of the fee

less than 2 weeks – 75% of the fee.

Cancellation must be made in writing.

Course Participants

  • Training is provided for the participants for whom it is intended. We strongly discourages the attendance of observers (for example, representatives of funders or staff wishing to develop their own training skills): these often have an undermining effect on the workshop, which is our purpose in being there. Please contact us if you wish to include any observers in a workshop. You should note that if we believe the presence of observers will be detrimental to the workshop we may need at that stage to withdraw from our commitments on the basis that the nature of the work we are being asked to provide has been changed and the quality of our work jeopardised.
  • All our courses are provided by deaf trainers. It is very unusual indeed for any communication support workers to be needed in addition to the trainer. If you believe, however, that it will be necessary to involve communication support workers for the training, please contact us first. Unnecessary and/or inappropriate communication support workers can have a serious detrimental effect upon the quality of the learning of your participants. If such communication support is to be arranged we will wish to discuss this with you so that the best options are taken up.

Review Meeting

We recommend that there is a review meeting with Laraine Callow (Director, Deafworks) after a contract has been completed to assess any future steps that are necessary. This is charged at our consultancy rate. The meeting can be at the client’s office or at Deafworks.

Future Work

  • Please note that the fees and expenses are calculated for each contract: and that for any subsequent contract the fee level and structure, and basis for expenses will be reviewed.
  • Any sub-contractors or members of staff used in completing a piece of work will not be permitted by their contract to work directly for the client organisation for a specific period after their contract with Deafworks. If you specifically want the person to carry out the work, please mention this when negotiating a fresh contract with Deafworks.

Materials

Unless agreed to the contrary with a specific client, all materials produced as part of a contract are copyrighted to Deafworks (such items as a research report, expert witness advice, DVD, etc.). All training materials used are copyrighted to Deafworks.

Publicity

We are often asked for and list organisations for whom we have carried out work: most organisations prefer to be included in this list. If you do not wish your organisation’s name to be included, please let Deafworks know.

Confidentiality

This is Deafworks’ policy, included in contracts for all staff and sub-contractors:

All information obtained through work carried out for Deafworks – basic personal details including individuals’ addresses for example, sensitive personal information, all financial and commercial information – is kept by members of staff/sub-contractors as confidential, and may not be used other than for the purpose of the business. It may only be shared (other than with Partners of the Firm) with others inside and outside the business with the express permission of one of the Partners. Information may not be divulged once the member of staff/sub-contractor has completed the piece of work. Any breach of confidentiality is regarded as major breach of the terms of the contract of employment or contract for services (as applicable).

Alterations to website

We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of our website or the content or services available through it, including your access to it. Unless explicitly stated to the contrary, any new features including new content and/or the sale of new Products shall be subject to these terms and conditions.

Please note that although we try to ensure that the content of our website it accurate, it may contain typographical errors or other inaccuracies.

Information you provide to us

Our privacy policy shall apply to any personal information which is collected by us from you.
